Offshore liability levy

According to Section 17f (5) of the Energy Industry Act (EnWG), network operators are permitted to recoup the cost of compensation payments by charging final consumers with a levy on the grid use charges. For up to 1,000,000 kilowatt hour per year of electricity for general purposes taken from the general supply network at one point of use, the grid use charge for end consumers may be increased, via the levy, by no more than 0.25 EUR cents per kilowatt hour (end consumer group A). For amounts beyond 1,000,000 kWh per year, the fee may be increased by no more than 0.05 EUR cents per kilowatt hour (end consumer group B). If end consumers are manufacturing enterprises whose electricity costs in the previous calendar year exceeded 4 per cent of their revenues (end consumer group C), the grid use charge may be increased, via the levy, for consumption beyond 1,000,000 kWh per year by no more than half the amount applicable to end consumer group B.

The levies on the grid use charges are based on a number of factors. Firstly, they are based on the predicted redistributable costs from compensation payments to offshore wind farm operators for 2017. The costs were predicted using a complex simulation model that was purpose-developed under scientific supervision. The relevant TSOs – TenneT TSO and 50Hertz Transmission – had these costs validated by independent auditors.

Moreover, offshore liability levies are determined based on the difference between the actual and predicted redistributable costs resulting from compensation payments to offshore wind farm operators for the year 2015.

Final consumer group A'

Electricity volumes supplied to final consumers for the first 1,000,000 kWh per point of use.

Final consumer group B'

Final consumers whose annual consumption exceeds 1,000,000 kWh at one point of use pay an additional maximum offshore liability surcharge of 0.05 EUR cents/kWh on electricity volumes exceeding 1 million kWh.

Final consumer group C'

Final consumers who are manufacturers or belong to the rail transport or the railway infrastructure sector and whose electricity costs in the previous calendar year exceeded four per cent of turnover pay a maximum of 0.025 EUR cents/kWh for electricity volumes exceeding 1,000,000 kWh.
